****We ( primarily Democratic Presidents and Congresses )have failed to understand that terrorism is fundamentally different from ordinary criminality and that Islamists, capable of suicide attacks and with non-utilitarian goals, are a fundamentally different kind of threat to civilization.
It's wishful and flawed thinking to believe that terrorists are "isolated" criminals and can be treated by the usual criminal justice system. They are organized, international and part of a network that is linked by a faith system that transcends earthly rationality. If Obama proclaims that the U.S. is not at war with Islam, it is still the case that Islam is at war with us. Mark Steyn has characterized Obama, and the first year of Obama, as "Islamo-schmoozing." This is pretending that Islam is benign, that deviants from civilized behavior are independent aberrations and that mollifying the Islamic world will solve the "problem." It may be that not all Muslims are terrorists but it is true that (pretty much) all terrorists are Muslims. Further, the goals of jihadi Islamists, making Islam and Sharia universal, has much wider support among Muslims that does specific endorsement of terrorism, although a shocking fraction of Muslims, even in Western countries, don't oppose it.
The nature of suicide attackers is fundamentally different from even other enemies and other terrorists. We are told that profiling wouldn't have caught Timothy McVeigh or the UniBomber but they were not suicide bombers and more usual measures of prevention, deterrence and punishment worked better for them. The usual protocols for airplane hijackings up until 9/11 were to go along with the hijackers because that was the way to avoid the loss of life. Even Palestinian terrorist-hijackers were concerned with saving their own lives and releasing fellow terrorists from prison ( a good argument for the death penalty, by the way, since it obviates attempts to free the previously convicted )up until 9/11. The simple goal of 9/11 terrorists, to kill as many people as possible and to do so will immolating themselves, was foreign to Western thinking until that time. That's the link to Islam and to Muslim terrorism that is unique. Even if the terrorists recruit blonde, blue-eyed Scandinavians to do their dirty work, it can only be via converting them to Islam since suicide mercenaries would be rather illogical.
Thus, it is a war not merely criminality. Rules of the criminal justice system do not apply and should not be applied. "We have a Constitution..." bleats the appeasers on the left but Justice Jackson once commented that the "Constitution is not a suicide pact." First of all, the protections of the Constitution do not apply to people who are not citizens, not even legal residents, not even residents and have not even been on American soil except to commit crimes against Americans. Even during a war, incarcerating on American soil enemy combatants captured elsewhere, does not afford Constitutional protections.
We are told that there are precedents, the 1993 World Trade Center bombers were tried in criminal courts and even Richard Reid, the shoe bomber was. Past mistakes are precedents only for the Supreme Court ( and not even always there! ). Further, we understand NOW better than we did in the past what the nature of Islamist terrorism is. We didn't understand the connection between the suicide bombing of the marine barracks in Lebanon in 1983, the Black Hawk Down incident, the first World Trade Center attack and on and on. Pundits even stressed the difference between Sunni and Shia Islam as if jihadists of both persuasions didn't want to kill us or convert us all to Islam ( they'd fight between themselves as to what flavor after this was accomplished! )
Coercive interrogation is not permissible to extract confessions, or for punishment but for obtaining information that will save lives from terrorist action should be a different matter. Whence comes our concern for the rights of terrorists ( transcendant concern in the case of Islamo-schmoozers ) when they cheerfully give up their own lives and "love death more than we love life" ( a famous Islamic mantra dating back to the seventh century and continually repeated in the 20th and 21st.)
Islamo-schmoozers can be the death of Western civilization yet.****
